Judge denies motion of Charlotte Diocese to dismiss sex abuse complaint

On February 10, 2012, Superior Court Judge Lane Williamson denied the motion of the Charlotte Catholic Diocese to dismiss the Complaint filed by attorneys Leto Copeley of Copeley Johnson & Groninger PLLC and  Seth Langsen on behalf of a plaintiff who alleges he was abused between the ages of 14 and 16 by Father Richard Farwell.  The plaintiff  alleges that the Diocese knew about Farwell’s potential for abuse and covered it up.  The Diocese asked the Court to dismiss all of plaintiff’s nine claims for relief; the Court allowed eight of the claims to go forward, including claims for constructive fraud, breach of fiduciary duty, fraudulent concealment, negligent hiring, supervision and retention, civil conspiracy, negligent and intentional infliction of emotional distress and equitable estoppel.
